TEQUILA VS. MERRIMAN: You Can't Sack Someone Who Might Be About To Drive Drunk

SEPTEMBER 8, 2009 -- Chargers linebacker Shawne Merriman says he was trying to stop a friend from driving drunk. It’s been debated whether TV personality Tila Tequila was under the influence of alcohol when she attempted to leave Merriman’s Poway home early Sunday. But whether Tequila was impaired or not, law enforcement and legal experts say you can’t use unreasonable force to stop a person from getting into a car.

San Diego Chargers linebacker Shawne Merriman was arrested and accused of choking and manhandling Tequila, an MTV reality show persona whose real last name is Nguyen. She signed a citizen’s arrest charging Merriman with battery and false imprisonment.

“We would all do our best to help a friend if we considered their actions to be detrimental to their personal safety,” Merriman said in a written statement.

Tequila posted a note on Twitter that said: “I’m allergic to alcohol…That is how I got the name Tila ‘Tequila’ cuz the irony. I cant drink.”

The owner of the downtown San Diego night club where Merriman and Tequila spent the evening partying in a VIP area took the rare step of commenting on what his employees reported to him about the night.

“It sounds like she’s allergic to the truth,” Stingaree owner James Brennan told the Associated Press. Brennan says Tequila drank shots of tequila and drank from a bottle of vodka. “She wasn’t falling down or anything of that nature, but she was visibly intoxicated.”

A spokesperson from the San Diego County Sheriff’s Department says there are basic steps allowable for stopping a person from getting behind the wheel. “You can take their keys, call them a cab or drive for them,” said public affairs officer Susan Plese. “But you probably shouldn’t assault them. If you’ve tried everything and they drive away, call 911.”

Tequila was examined by paramedics and no injuries were reported. Asked if he threw Tequila to the ground, Merriman declined comment.

“You don’t have a legal right to force someone to do what’s good for them,” says David Steinberg, a professor who teaches criminal law at Thomas Jefferson School of Law. “Granted, we don’t know what went on. But it’s implausible to say you choked someone for their own good.”

Steinberg said Merriman would not be legally liable if Tequila did leave his house in a drunken state and then inflicted bodily harm on herself or others.

“These are complex situations,” said Eloisa Orozco, program specialist for Mothers Against Drunk Driving. “At MADD, we focus on alternate transportation or getting a designated driver ahead of time. Plan ahead—but if you do get in a situation, use common sense.”

An investigation into the Merriman/Tequila incident is ongoing, said Poway Sherif Station detective sergeant Bill Giltner.

Does it also disturb you that anyone can call the cops and allege an assault and get your tail tossed into the can via "citizens arrest"?

From what I heard, the apologetic sheriffs deputies explained to Merriman that they were required by law to arrest him.

maybe he prevented her from killing someone on the freeway or getting a DUI?
I was raped while intoxicated as a virgin @ 20 and conceived a baby daughter from this unusual encounter. Man was officer in the Air Force. It was a date rape so watch out young ladies. Shit happens and just because someone has a big name they are still supposed to be held accountable. I wasn't at Merriman's party nor the Stingaree but sometimes it is best to hail a taxi and go home alone. Besides, when you go to bed with dogs you end up with fleas!jj

How will we know?
Just like the many athletes who carry on without any action at all, Merriman "charges" on. Tila IS crazy, but somehow that has enabled everyone to accept this as "she asked for it." Thought we overcame that defense decades ago. FACT: She has bruised arms. Somehow someone used excessive force and if you aren't legally allowed to even touch a person under these circumstance, seems clear to me. Lightning bolt flash...athletes are not above the law!!! We really should have a higher standard. Inflated egos are dangerous!

Merriman or not so Merryman—
Like Madd inferred, stopping someone from driving drunk is a bad situation. What makes it worse is that the person drunk is yelling directly at you and their breath and spit reeks of alcohol which elevates the impulse to stop them from drinking. Also, attempting to grab the drunk's keys can often result in everyone tumbling down.
I was once with friends in a bar where the party didn't get the keys. The guy got three miles away when he drove head on into a telephone pole that had held a major power transformer. It knocked out all the electricity in the area including the bar's. Suddenly there was no lights and no music from the juke box which was a bummer. Later, while driving home there were no traffic lights which made the night even more memorable. The family of the deceased sued the bar and won the case and the bar closed down. A sad story indeed—
